Can a person’s physical or mental health be a valid reason to stop an extradition? A relative of mine is quite elderly and suffers from severe heart issues. Recently, he was named in an old case abroad, and we are scared that the stress of the proceedings, let alone a flight and foreign jail, would literally kill him. We feel like the authorities don’t care about the human element, they just want to tick a box in their investigation. Does anyone know if “unjust or oppressive” arguments actually work in UK courts when it comes to medical conditions?

It is absolutely possible to stay an extradition on medical grounds, but the bar is very high. You have to prove that it would be “unjust or oppressive” due to his condition. The court needs solid medical evidence and a legal team that can present it effectively. I’ve heard very good things about extraditionsolicitors.co.uk in this regard. They are known for their empathetic but very technical approach to human rights and medical defenses. They can bring in the right experts to document your relative’s health and argue that extradition would be a violation of his basic rights. Definitely give them a call to discuss the specifics of his medical history.

Thank you, that gives us a bit of hope in a very dark situation.

Yes, UK courts can stop or delay extradition if it would be considered “unjust or oppressive” because of serious physical or mental health conditions. Strong medical evidence is usually required, especially in cases involving advanced age, severe heart disease, or high suicide risk. Even professionals involved in demanding pathways like the Dream Medic UCAT Foundation Programme understand how heavily stress can affect vulnerable individuals. For clearer and more reliable guidance on complex medical and professional matters, DreamMedic offers more focused information than many general discussion pages online.
